  • Car backed into.. Insurance Question

    So this dude hit my rear bumper with his tire on his truck. He works for a trucking company and they decided to pay out of pocket instead of going through insurance. The estimate came out to $933. They said they'd pay it, but they want to give the money right to the shop that gave the estimate and not to me directly.

    Well first off the cars is 3 hours away in my garage at home and I took the plates and insurance off because I dont drive it in the winter now that I have a winter car(this happened right before I was taking the car off the road so its been a real pita). Second I dont necessarily know if this is the shop that I want to fix it. Third I might sell the car before that and just subtract the cost of the fix since I know it wont be a few months atleast till it's fixed since this shop is really busy and I have to wait till spring and all that.

    My question is, I thought it was my choice to do what I wanted with the money? Or am I wrong?

    you should be able to fix it at the shop of your choosing

    first and foremost, is there a police report?

      You have the choice to pick the body shop if you want to fix it. But they can do what ever they want to do with the money, so sometimes they dont want ppl to benefit from the incident like taking the $933 and getting it fixed for $450 and having money left over to get drunk with so they bring it straight to the shop. Insurance sucks, good luck!

        Technically, you can do what you want... which is why it is smart to go through insurance, so they have to pay out to them and you don't have to deal with it.

        I would simply tell them to pay you the check, or have them go through your insurance. However, if you don't have a police report or anything that proves that the truck hit you, then you might be SOL.

        Side note: Guys... ALWAYS get a police report. period. Without it, it will be "he said, she said" and if it gets taken to small claims, whoever has the witnesses on their side, wins. Either that, or the judge won't care and make you pay for your own damages no matter whose fault it is.

          yeah. i was thinking about paying a shop 50 bucks to recieve the money and then send it over to me but that sounds too risky. I dont want to get fucked over

          There is a police report. I guess Ill tell them to send me the check or I'll just call their insurance. It sounds to me that they really dont want to go through insurance so hopefully that will get them to pay. But I also dont want to piss them off..

            Actually, I just got an email from the trucking co. and they are just sending me the check for the full amount. Turns out they aren't assholes and are a lot more understanding than I thought. lol nice.

                  Everyone is making this complicated.

                  Tell them "Pay me the money directly, or I will go through your insurance, who will pay me directly, and they'll up your rates while you're at it."

                  Done.

                  Everyone is talking about what you "can" and "can't" do, and if they "have" to give you money, or "body shop" this and that.

                  You didn't go through insurance. There ARE no rules. You didn't have to get a quote to begin with. You could say "If you don't want to settle through insurance, give me $1k." You could say $2k if you wanted. It doesn't matter. You control the situation.

                  They have to pay you for it- if they don't, go through insurance and make them. Simple as that.

                  If an accident, no matter how big or small, is not your fault, you CONTROL the situation.

                  How else would I have gotten $6k for my e28 in stock form when it was totaled?

                    well I know in NC you are not required to get multiple quotes from body shops.

                    I was rear-ended by an employee where i used to work IN a company truck lol. He was behind me driving the company box truck and I was in my car in front of him and he bumped me. all it did was put a small ding in my trunk lid and about a 6" black mark on my bumper.

                    So i took it to the stealership and quoted an NEW bumper, NEW trunk lid, NEW spoiler and a paint/fade. So that was like 3 grand. Company paid me and I took part of the money and bought my wheels and put the other part in savings lol

                    The body damage doen't really bother me at all, so I just said fuck it lol

                        Thanks man. I appreciate the input. I'll definitely keep this stuff in mind with any future incidents. The only reason I wasn't pushing my luck this time is the police said that I wasn't parked in a parking spot(total bs but it's in the police report) and that I didn't have permission to be there(I left my car at the gas station while I went to help my friend with his car for an hour).

                        I'm happy with the $933 though. Coilovers for my 240

                          If I had the option, I would only pay someone out of pocket if I had a say in where the car got fixed.

                          I backed into some girl's car when I was 18 and had my 2001 Jeep Grand Cherokee. Not a single scratch to my car, but her rotted out 1990 Honda Accord basically fell apart. Pushed the rear arch rot/rust in with my bumper, causing her bumper to fall off on one side, the taillight fell out and broke on the ground. She had it quoted at $590 to fix, so afraid that my already high insurance rates (18 y/o male, V8-powered midsize SUV) would go up, I paid her cash. I should have told her that I'd buy her a new 1990 Honda Accord for the $590 :lol: This thing was a pile, the entire car was probably worth about that.

                          Long story short, I saw the car the next week (she dated a guy from across the street), with the rear end of her car all duct-taped together, including tape holding the taillight in. She got out with a brand new giant Coach purse.

                          That's what's frustrating about paying out of pocket. Just a little insight from the other side. No offense to you, hell, I'd probably do the same thing (except it probably wouldn't be a designer bag).
